This document sets forth the terms and conditions of use (the "Terms and Conditions") of the IPTV506 application which is the exclusive property of AMERICAN DATA NETWORKS S.A., with legal identification number 3-101- 402954, ("AMERICAN DATA").
    These Terms and Conditions contain the obligations that govern the relationship between AMERICAN DATA and each of the users of the Application (the "User"). These Terms and Conditions shall apply to and be deemed to be incorporated into each and every contract entered into by Users with AMERICAN DATA through the Application.
    The use of the Application, the application of these Terms and Conditions, the acts that are executed and the contracts that are entered into through the Application, are subject to the laws of Costa Rica.

    Acceptance of Terms and Conditions of Use

    By using the Application, the User expresses its knowledge and acceptance of the totality of these Terms and Conditions. In addition, the User must click where the Application offers this option in the User's interface with the phrase "I accept the Terms and Conditions" or other equivalent that allows the User to give his/her unequivocal consent regarding the acceptance. By clicking "I accept the Terms and Conditions", the User is agreeing that he/she has read and understood these Terms and Conditions, and is bound by them, as they may be changed from time to time. AMERICAN DATA reserves the right, at its sole discretion, to modify, alter, or otherwise update these Terms and Conditions at any time. Therefore, it is suggested that you review these Terms and Conditions each time you use the Application.
    Any change to the Terms and Conditions will be effective as of the effective date of that change, and will not affect any dispute that has arisen prior to the effective date of that change. If User does not agree to any change to these Terms and Conditions, User shall notify AMERICAN DATA of its request to terminate and delete any account it has with the Application.
    User's failure to agree to the Terms and Conditions will result in User's inability to register, use and enjoy the services offered through the Application.

    Use of the Application

    Through the Application, the User will be able to access the contents and services offered therein. The User must use the Application in accordance with morality and good customs, as well as in accordance with the provisions of these Terms and Conditions and, in general, the laws of Costa Rica.
    AMERICAN DATA may, at any time and without prior notice, deny the use or withdraw access to the Application to those Users who violate the Terms and Conditions stipulated in this document, as well as the laws that govern the matter.

    AMERICAN DATA’s Liability

    In no event shall AMERICAN DATA be liable for:

    a) The improper use that Users of the Application may make of the materials displayed, of the industrial property rights and of the intellectual property rights of AMERICAN DATA contained therein.
    b) Damages caused to the Users by the malfunctioning of the Application and the errors generated by any failure of the technologies or the technical elements of the Application.
    c) Damages caused to the Users, arising from the improper use of the technologies made available to them, regardless of the way in which these technologies are improperly used.
    d) Damages caused by the improper and bad faith use of the Application by the Users.
    e) Viruses or other elements in the electronic documents stored in the computer systems of the Users.
    f) Loss, misuse or unauthorized use of your password and/or means of payment, either by the User or third parties.
    g) Malfunction, deficiencies, unavailability or errors related to the eventual use of credit or debit cards, or electronic payment systems, as these are not AMERICAN DATA's responsibility. The payment systems and their operation are exclusively regulated by the contractual relationship between the User and the respective bank or institution issuing or operating such cards, systems or payment accounts.


    In order for AMERICAN DATA to provide the services offered through the Application, the User agrees to be a customer of AMERICAN DATA, duly registered through the pre-established information forms for this purpose. Likewise, the User authorizes the entry of such data in the Application, including, but not limited to, full name, ID, address, contact telephone numbers that were previously provided to AMERICAN DATA when the user was enabled as a customer of AMERICAN DATA. AMERICAN DATA will provide the User with instructions for the use of the Application. User is responsible for maintaining the confidentiality of User's password and account. You agree that you are fully responsible for all activities that occur under your password and account.
    It is prohibited to access the Application using a false, erroneous, nonexistent or non-existent name, account, password or email address of which the User is not the owner. If you become aware that a security breach of your account has occurred, you must immediately inform AMERICAN DATA through our customer service line to notify us about this infiltration and manage the change of your password. You agree that, unless you have notified us of such a breach of your account, AMERICAN DATA will assume that any activity generated from your account has been authorized by you.
    AMERICAN DATA reserves the right to terminate your account, and/or provide appropriate information to appropriate authorities upon request and where necessary, if you commit fraud; provide false or misleading information for the purpose of registration; violate these Terms and Conditions; abuse your account privileges; or use your account in any way that may be harmful to AMERICAN DATA.

    User Obligations

    You may not use the Application to:

    a) Violate any national or international law.
    b) Modify, reproduce by any means, save, store, transmit, or distribute material contained in the Application, whether for personal or commercial purposes, unless expressly authorized by AMERICAN DATA to do so.
    c) Modify, reverse engineer, disassemble, disassemble, reduce to human perception or create derivatives based on the Application or any of the software used for, or in connection with, the Application.
    d) Introduce any virus or any other code or routine with the intent to disrupt the Application, to acquire or record information from the Application or its users, or to interfere with the operation of the Application.
    e) Carry out acts that impede the normal operation of the Application.
    f) Provide false or incorrect information that may mislead or cause damages to AMERICAN DATA and/or third parties.
    g) Infringe with any industrial or intellectual property right of AMERICAN DATA and/or third parties.
    h) In general, carry out acts that generate any damage or harm to AMERICAN DATA and/or third parties.

    AMERICAN DATA may initiate the judicial or extrajudicial processes that you consider pertinent in case of violation of these Terms and Conditions or the laws of Costa Rica.

    Use of the Application

    AMERICAN DATA will make available to the User a list of the contents and services that can be ordered through the Application.

    Intellectual Property Rights

    All the contents included in the Application, such as texts, graphic material, logos, button icons, source codes, images, audio clips, digital downloads and data compilations, among others, are the property of AMERICAN DATA or its content providers, and are protected by national and international laws on intellectual and industrial property. The graphic materials, logos, page headers, advertising phrases, button icons, written text and service names included in this Application are trademarks, trade dress or trade dress owned by AMERICAN DATA here and in other countries. Such trademarks, trade dress and trade dress may not be used in connection with any product or service that is likely to cause confusion among customers and in any manner that disparages or discredits AMERICAN DATA. All other trademarks not owned by AMERICAN DATA that appear on this Application belong to their respective owners.

    All rights not expressly granted in these Terms and Conditions are reserved by AMERICAN DATA or its assignees, suppliers, publishers, rights holders or other content providers. Nothing contained in the Application such as, but not limited to, products, images or sounds may be reproduced, duplicated, copied, sold, resold, visited or otherwise exploited for any purpose, in whole or in part, without AMERICAN DATA's prior written consent. You may not frame or utilize framing techniques to enclose any trademark, logo, or other proprietary or registered information (including images, text, page layout, or form) of AMERICAN DATA without AMERICAN DATA's prior written consent. You also may not use meta tags or any other "hidden text" utilizing AMERICAN DATA's name or trademarks without AMERICAN DATA's prior written permission. Misuse of this Application or these trademarks, licenses or patents is prohibited. The foregoing is without prejudice to the exceptions expressly provided by law.

    Informed consent to collection and processing of personal data by AMERICAN DATA NETWORKS

    I, the undersigned, hereinafter referred to as the Data Subject, hereby declare that I understand, accept and give my consent, by including my data in this form and clicking on the "I ACCEPT" button, for AMERICAN DATA to collect and process the personal data to be stated, under the terms and conditions below.
    1. The data provided to AMERICAN DATA by the Data Subject will be processed under the principles set forth in the Law for the Protection of the Individual from the Processing of Personal Data and its regulations (lawfulness, informed consent, quality of information, appropriateness of use and guarantee of the exercise of the rights of the data owner).

Exercise of the Rights of the Data Subject At any time, the Data Subject has the right to ACCESS the Personal Data and the details of the processing thereof, in order to RECTIFY them in case they are inaccurate or request their CANCELLATION when he/she considers that they are excessive or unnecessary for the purposes that justified their collection or OPPOSE to the processing thereof, by means of a free written request that complies with the requirements established in the Law and sent by e-mail to dirección:comercial@data.cr.
    7. To revoke his/her consent, the Interested Party must submit a request to the e-mail address indicated above indicating the scope of his/her revocation.
